RE: The tariff classification of a dickie from China.

Dear Mr. Sachs:

In your letter dated November 14, 2004 you requested a classification ruling.

The submitted sample, no style number indicated, is a dickie composed of knit 90% cotton/10% spandex fabric. The item is a mock turtleneck style with a semi circle front and back. The dickie is worn under a suit or shirt or blouse.

The applicable subheading for the dickie will be 6117.80.9510, Harmonized Tariff schedule of the United States, (HTS), which provides for "Other made up clothing accessories, knitted or crochetedOther accessories: Other: Other, Of cotton." The duty rate will be 14.6% ad valorem. The textile category designation is 359.
