RE: The tariff classification of pet placemats and toys from China

Dear Mr. Mento:

In your letter dated August 5, 2004, you requested a tariff classification ruling on behalf of the Dallas Manufacturing Company of Dallas, Texas.

The submitted samples are identified as two pet placemats and three pet toys.

The two pet placemats, in the shape of a fish and a bone, are made of 65 percent polyester and 35 percent cotton and contain a thin layer of polyurethane foam between the top and bottom pieces of fabric. You indicate that the purpose of the pet placemat is for placement on the floor underneath a pet’s food dish and water bowl. The placemat also has a non-skid surface with rubber dots on the under side to keep it from slipping across the floor.

The Rope Bone Toy is a foot-long dog chew toy that you indicate consists of 75 percent cotton and 25 percent polyester yarns wound together forming a twisted rope approximately one inch in diameter, knotted at each end.

The Scratch/Swat Toy is a cat’s scratch pad in the shape of a mouse. The pad is made of 100 percent acrylic carpet covering a piece of middle density fiberboard. A spiral metal wire topped with a 100 percent acrylic pom-pom screws into a plastic base to simulate the mouse’s tail.

The Plastic Jingle Balls are a set of four plastic jingle balls in a plastic container. The balls are made of hard plastic that have cut out openings all around. Each one also contains a metal bell inside.

The applicable subheading for the placemats will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up textile articles, other. The rate of duty will be 7 percent ad valorem.

The applicable subheading for the Rope Bone Toy will be 5609.00.1000, HTS, which provides for articles of yarn, twine, cordage, rope, or cables, not elsewhere specified or included, of cotton. The rate of duty will be 2.9 percent ad valorem.

The applicable subheading for the Scratch/Swat Toy will be 6307.90.7500, HTS, which provides for toys for pets, of textile materials. The rate of duty will be 4.3 percent ad valorem.

The applicable subheading for the Plastic Jingle Balls will be 3924.90.5500, HTS, which provides for other household articlesof plastics: Other, Other. The rate of duty will be 3.4 percent ad valorem.

All samples will be returned as requested.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
