RE: The tariff classification of glass rods from China

Dear Ms. Seamands:

In your letter dated July 20, 2004, on behalf of Seattle Batch Company, you requested a tariff classification ruling regarding glass rods (item 48D) from China.

Samples were submitted with your ruling request.

In your letter you indicated that the rods are unworked and are obtained directly from the drawing process. You stated that the rods are colored prior to solidification with a specific color inserted into the glass batch before the material solidifies.

This ruling will only address the simple glass rods described above - unworked rods colored prior to solidification. In an earlier letter you had also described other products - colored glass rods encased within clear glass rods, as well as glass rods containing various decorative effects. We had asked for samples and further information on these items. However, you did not submit samples or information on the method of production for these more complex products. Therefore, this ruling will only cover the simple glass rods, not the colored rods within clear rods or any of the other complex products described in your earlier letter.

The applicable subheading for the simple glass rods will be 7002.20.5000, HTS, which provides for glass in balls (other than microspheres of heading 7018), rods or tubes, unworked: rods: other. The rate of duty will be 6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
