RE: The tariff classification of candleholders from China.

Dear Ms. Jones:

In your letter dated July 19, 2004, you requested a tariff classification ruling.

The subject merchandise, based on the submitted samples, consists of the following candleholders:

1) colored-ribbed cylindrical-shaped glass candleholders measuring approximately 2 ¾ inches in height with an open-top diameter of 2 inches.

2) a clear-transparent cylindrical-shaped glass candleholder in a four-legged decorative metal (non-brass) stand measuring about 4 7/8 inches in overall height. The glass holder measures about 3 1/8 inches high with an open-top diameter of 2 7/8 inches and an interior depth of 2 ¾ inches. It is noted that the glass holder has a flat rim for resting atop the metal stand.

It is stated that these articles are included in the candle gift sets (not sets for tariff purposes) that are identified as NC4356 ands NC4357.

The applicable subheading for these candleholders will be 9405.50.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for other non-electrical lamps and lighting fittings, other. The rate of duty will be 6 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
