RE: The tariff classification of boys’ knit pullover garments from Swaziland.

Dear Ms. Fontecchio:

In your letter dated July 16, 2004, you requested a tariff classification ruling on behalf of Goody’s Family Clothing, Inc. As requested, your samples will be returned.

Style 1204114 is a boys’ (sizes 4 through 7) pullover garment constructed from 100 percent cotton, jersey knit fabric that measures 26 stitches per two centimeters counted in the horizontal direction. Style 1204114 has a loose fitting body and features a rib knit crew neckline; long, loose fitting sleeves with rib knit cuffs; a half moon at the rear neckline; and a straight, hemmed bottom.

Style 1254114 is a boys’ (sizes 8 through 20) pullover garment constructed from jersey knit fabric that measures 26 stitches per two centimeters counted in the horizontal direction. The fiber content will be 60 percent cotton, 40 percent polyester in heather grey color and 100 percent cotton in all other colors. Style 1254114 has a loose fitting body and features a rib knit crew neckline; long, loose fitting sleeves with rib knit cuffs; a half moon at the rear neckline; and a straight, hemmed bottom.

The applicable subheading for Styles 1204114 and 1254114 will be 6110.20.2065, Harmonized Tariff Schedule of the United States, (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: men's or boys'. The general rate of duty will be 16.5 percent ad valorem.

Styles 1204114 and 1254114 fall within textile category designation 338. Based upon international textile trade agreements, products of Swaziland are not presently subject to visa requirements or quota restraints.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
