RE: The tariff classification of various parts for conveyors from China

Dear Mr. Kavanaugh:

In your letter dated July 2, 2004, on behalf of your client Poulies Maska Inc., you requested a tariff classification ruling. You included samples and descriptive literature with your request.

The articles at issue are three items used as components for conveyors: (1) part LO35x1/4, referred to as a starflex coupling; (2) part LO75N, identified as a spider; and (3) part P50, Rubber Wheel. Items (1) and (2) are made of Hytrel®, a thermoplastic polyester elastomer. Item (3) is said to be of natural rubber. The various components can be imported in a wide variety of sizes

The applicable subheading for the starflex coupling and the spider components will be 8431.39.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for parts of conveyors. The rate of duty will be free.

The applicable subheading for the rubber wheel will be 4016.99.3500, HTS, which provides for other articles of vulcanized rubber other than hard rubber, of natural rubber, other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
