RE: The tariff classification of a BTSOMA Assembly Kit from Japan

Dear Ms. Metzger:

In your letter dated July 7, 2004, you requested a tariff classification ruling. No sample was submitted.

You state: “We import a BTSOMA Assembly Kit (our identification number is Option Kit No. 99M-1-37000, material number 27M37000UL-A1) in a ‘Knock Down’ form. All required parts to assemble and install the Broken Tool Sensor Outside the Machining Area (BTSOMA) are packaged in one crate. We purchase, receive, and inventory this Assembly Kit as a single unit. No spare parts are contained in the kit as packaged.”

From the information you sent, we understand the import to be all the unassembled parts necessary to make a device which, by using styli, will measure the cutting tools which are not in use, but in a waiting area, to determine if they are defective by comparing the measurements made with the stored information of the measurements of the cutting tools when they are not defective. If the measurements do not match, a signal will be generated that will notify the machine tool not to use that tool.

The applicable subheading for the Assembly Kit will be 9031.80.8085, Harmonized Tariff Schedule of the United States (HTS), which provides for “other,” non-“optical,” measuring or checking instruments, appliances, and machines. The rate of duty will be 1.7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
