RE: The tariff classification of “B/O Pro Hockey” from China

Dear Mr. VerPault:

In your letter dated July 14, 2004, on behalf of CVS/Pharmacy, you requested a tariff classification ruling.

You submitted descriptive literature and a product sample with your request. That sample is being returned to you as per your request. The subject merchandise is CVS item # 246792, known as “B/O Pro Hockey”. This is a small scale, battery operated, plastic air hockey game, featuring fan generated air suspension. It will be imported in a box packaged for retail sale. Also included in the box are the accessories needed for play: two playing paddles, two pucks, two goal nets, and a plastic strip that stores the other pieces. A manual score keeper is also part of the package.

The applicable subheading for the “B/O Pro Hockey will be 9504.90.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for Articles for arcade, table, table or parlor games, including pinball machines, bagatelle, billiards and special tables for casino games: Other: Game machines, other than those operated by coins, banknotes (paper currency) discs or similar articles; parts and accessories thereof. The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
