RE: The tariff classification of preserved vegetables and fruit from China.

Dear Mr. Gat:

In your letter dated June 22, 2004, you requested a tariff classification ruling.

The sample submitted with your letter was forwarded to the Customs laboratory for analysis. Item no. FV-210032C consists of red chili peppers, green chili peppers, kumquat slices, and starfruit slices, in a liquid medium. The product is put up in a bottle measuring 17-1/4 inches tall. Laboratory analysis found the item contained 4.79 percent acetic acid.

The applicable subheading for item no. FV-210032C will be 2001.90.6000, HTS, which provides for vegetables, fruit, nuts and other edible parts of plants, prepared or preserved by vinegar or acetic acid...other...other...other. The rate of duty will be 14 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
