RE: The tariff classification of electrical cables from Taiwan.

Dear Ms. Lopez:

In your letter dated June 14, 2004, on behalf of your client Wieson America Inc. you requested a tariff classification ruling.

The merchandise under consideration consists of four insulated cables and one connector. Samples of all five items were submitted with your ruling request. They are identified in your ruling request as RJ 45 8P8C Plug (P/N: 9213E024-009), MD 8 P/M to BNC Plug (P/N: 9302E024-001), Phone Plug 6P4C to 6P4C (P/N: 9207E024-005), USB Cable (P/N: 9903E024-006) and A1012 Series Din Sockets.

The RJ 45 8P8C Plug is a 24AWG, 8 conductor standard LAN cable with standard telephone type male connectors at both ends measuring approximately 70 inches. This cable is designed for use in a Local Area Network (LAN).

The MD 8 P/M to BNC Plug is a 3C-2V 75 OHM Coaxial Cable measuring approximately 40 inches long with a male BNC plug on one end and a male 8 pin round connectors at the other ends. From the information provided by you, this cable is designed for connecting a medical personal computer (PC) to a medical device monitor.

The Phone Plug 6P4C to 6P4C is a 26AWG, 4 conductor standard telephone cable rated at 150 V. This cable measures approximately 72 inches long with male connectors at both ends.

The USB (Universal Serial Bus) Cable is a 4 conductor cable rated at 30 V with two 28AWG and two 24AWG wires measuring approximately 40 inches. This cable has a 4-pin Type A USB port plug at one end and a Type B at the other end. As per your literature, this cable serves as a connection between a PC and other USB devices.

The Series Din Socket is a miniature circular female 6-pin socket/connector with a full metal shield. This connector is designed to be permanently attached to a printed circuit board (PCB) protruding on a 90º right angle and accepts a round male 6-pin plug from other devices such as a keyboard or mouse.

While your request describes the cables as telecommunication cables, part number 9903E024-006 can not be identified as such. It does not appear to meet the description of telecommunications wire and cables found in 85.44 of the Harmonized Commodity Description and Coding System Explanatory Notes ("ENs"). You have also failed to document that it is of a type principally used in telecommunications or that it meets recognized telecommunication wiring standards.

The applicable subheading for the RJ 45 8P8C Plug (P/N: 9213E024-009) and the Phone Plug 6P4C to 6P4C (P/N: 9207E024-005) will be 8544.51.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Insulated (including enameled or anodized) wire, cablewhether or not fitted with connectors Other electric conductors, for a voltage exceeding 80 V but not exceeding 1,000 V: Fitted with connectors: Fitted with modular telephone connectors.” The general rate of duty will be free.

The applicable subheading for the MD 8 P/M to BNC Plug (P/N: 9302E024-001) will be 8544.20.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Insulated (including enameled or anodized) wire, cablewhether or not fitted with connectors Coaxial cable and other coaxial electric conductors.” The general rate of duty will be 5.3 percent ad valorem.

The applicable subheading for USB Cable (P/N: 9903E024-006) will be 8544.41.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Insulated (including enameled or anodized) wire, cablewhether or not fitted with connectors Other electric conductors, for a voltage not exceeding 80 V: Fitted with connectors: Other.” The general rate of duty will be 2.6 percent ad valorem.

The applicable subheading for the A1012 Series Din Socket will be 8536.69.4040, Harmonized Tariff Schedule of the United States (HTS), which provides for “Electrical apparatusfor making connections to or in electrical circuitsfor a voltage not exceeding 1,000 V: Lamp-holders, plugs and sockets: Other: Coaxial connectors; cylindrical multicontact connectors; rack and panel connectors; printed circuit connectors; ribbon or flat cable connectors: Printed circuit connectors.” The general rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
