RE: The tariff classification of a zippered purse, a sewing needle, safety pins, buttons, a nail file, and adhesive dressings from China

Dear Mr. Molto:

In your letter dated June 23, 2004, you requested a tariff classification ruling on behalf of CE Design, Inc., of New York City, New York.

You submitted a zippered purse containing a nail file and a plastic bag that contains thread wound on a card, a sewing needle, and safety pins. You also state that Band-Aids® will be included, although no samples were received.

The zippered purse is a coin purse that is constructed of man-made fiber textile and measures approximately 4¾”W x 3½”H.

The applicable subheading for the coin purse will be 4202.32.9550, Harmonized Tariff Schedule of the United States (HTS), which provides for articles of a kind normally carried in the pocket or handbagof man-made fibers. The duty rate will be 17.6 percent ad valorem.

The applicable subheading for the sewing needle will be 7319.10.0000, HTS, which provides for sewing needles. The duty rate will be Free.

The applicable subheading for the safety pins will be 7319.20.0050, HTS, which provides for safety pins. The duty rate will be 4.5 percent ad valorem.

The applicable subheading for the buttons will be 9606.21.4000, HTS, which provides for buttons of acrylic resin. The duty rate will be 0.3 cents/line/gross + 4.6 percent ad valorem.

The applicable subheading for the nail file will be 6805.20.0000, HTS, which provides for natural or artificial abrasive powder or grainon a base of paper or paperboard only. The duty rate will be Free.

The applicable subheading for the Band-Aids® will be 3005.10.5000, HTS, which provides for adhesive dressings. The duty rate will be Free.

Your inquiry does not provide enough information for us to give a classification ruling on the yarn. Your request for a classification ruling should include the fiber content of the yarn. Please indicate whether it is staple or filament fibers, the decitex, and whether or not it is dressed for sewing thread. When this information is available, you may wish to consider resubmission of your request. We are returning any related samples, exhibits, etc. If you decide to resubmit your request, please include all of the material that we have returned to you.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
