RE: The tariff classification of a Nuclear Rain Wear Coverall from China.

Dear Mr. MacDonald:

In your letter dated June 22, 2004, on behalf of Unitech Service Group, you requested a classification ruling.

The submitted sample is a ProTech 2000 Item #COV-20A Nuclear Rain Wear Coverall that is constructed of woven 98% nylon and 2% carbon core filament fabric. The coverall features raglan sleeves, double thickness stand up collar with color coding for size, a full front zipper closure covered with a flap, elasticized wrists and ankles with adjustable snaps, specially constructed clear patch pocket, rear vent and seams with two needle felled stitching. The coverall is shown in descriptive literature being worn by both men and women and comes in sizes XSmall to 9XL. The coverall is specifically designed for the nuclear power and clean-up industry and offers high barrier protection and a 99.9% spray repellency rating.

The applicable subheading for the ProTech 2000 Item #COV-20A Nuclear Rain Wear Coverall will be 6211.43.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for Other garments, women’s or girls’, of man made fibers, Coveralls, jumpsuits and similar apparel: Other: Women’s. The duty rate will be 16% ad valorem.

The ProTech 2000 Item #COV-20A Nuclear Rain Wear Coverall falls within textile category designation 659. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
