RE: The tariff classification of gloves from China.

Dear Ms. Ricciardi:

In your letter dated May 21, 2004, you requested a tariff classification ruling.

Style M8651 is a gunn cut glove with a complete palmside from the fingertips to the wrist and half of the hemmed palmside 1-1/2 inch long cuff constructed of goat suede leather. The balance of the glove is made of a woven nylon fabric. Additional features include an inner lining, insulation, a partially elasticized wrist, a hook and clasp, padded internal knuckle reinforcement, and a backside leather wrist strap with a snap closure. The glove lacks reinforcement along the palmside thumb required to meet the stress caused by the flexing of the knuckles when a skier grasps the ski pole. Therefore, your assertion for classification as a cross country ski glove is not applicable.

The applicable subheading for Style M8651 will be 4203.29.3020, Harmonized Tariff Schedule of the United States (HTS), which provides for Articles of apparel and clothing accessories, of leather or of composition leather: gloves, mittens and mitts: other: other: other: men’s . . . lined. The rate of duty will be 14 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
