RE: The tariff classification of a plastic child’s tray from China.

Dear Mr. Pagano:

In your letter dated June 14, 2004, you requested a classification ruling.

The submitted sample is a child’s tray (no style number indicated). The tray is made of 100 percent plastic. The tray can be used as a food tray for eating in front of the television, in bed or in the car, as a reading tray or as a large play area surface. It is designed with a large built in pocket on one end. A large drinking cup holder and small built in pocket are included on the other end. The tray measures approximately 8 inches high by 12 inches wide by 22 inches long.

The applicable subheading for the plastic child’s tray will be 3924.90.5500, Harmonized Tariff Schedule of the United States (HTS), which provides forother household articlesof plastics: Other: Other. The rate of duty will be 3.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
