RE: The tariff classification of an unassembled handbag from China.

Dear Ms. Krupskas:

In your letter dated June 15, 2004, on behalf of Horizon Fabrics, you requested a classification ruling.

The sample submitted is identified as “Totally Denim Accessory Kit”, item A13277. This kit is to make a denim handbag constructed of 75% cotton and 25 polyester, change purse of 100% cotton, and keychain. Included in this activity kit are the denim items in addition to beaded fringe, sequin strip, acrylic rhinestones, satin ribbon, butterfly applique, maylar mirror and craft glue. For classification purposes the items are considered to be an unassembled handbag and will be classified accordingly. Your sample is being returned as requested.

The applicable subheading for item KA13277 will be 4202.22.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strap, including those without handle, with outer surface of textile materials, of vegetable fibers, and not of pile or tufted construction, of cotton. The duty rate will be 6.3 percent ad valorem.

HTS 4202.22.4500 falls within textile category designation 369. Based upon international textile trade agreements products of China are not currently subject to quota and the requirement of a visa.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
