RE: The tariff classification of a woman’s knit romper from China.

Dear Mr. Du:

In your letter dated, April 25, 2004, you requested a classification ruling.

The submitted sample, Style #ISD-86-M, is a woman’s 87% nylon, 13% spandex knit romper. The romper features a U-shaped neckline in front, shoulder straps that criss-cross in the back, and side slits. The lower part of the garment has a skirt silhouette, an attached panty, and a hemmed bottom.

We are returning your sample as you requested.

The applicable subheading for the romper, Style #ISD-86-M, will be 6114.30.3030, Harmonized Tariff Schedule of the United States (HTS), which provides for other garments, knitted or crocheted, of man-made fibers, other, sunsuits, washsuits, one-piece playsuits and similar apparel, women’s or girls’. The duty rate will be 14.9 % ad valorem.

Style #ISD-86-M, falls within textile category designation 237. Based upon international textile trade agreements products of China are subject to quota restraints and visa requirements.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
