RE: The tariff classification of carrying cases from India.

Dear Ms. Lang:

In your letter dated May 24, 2004, you requested a classification ruling.

You have submitted two samples and literature of three other items described as “Craft Organizers”. They are as follows:

1) CA 10 Mini Craft Organizer Petite
2) CA 14 Mini Craft Organizer Large
3) CA 20 Compact Craft Organizer
4) CA 43 Hand Craft Organizer
5) CA 120 Yazzii Carry All
6) CA 58 Supreme Organizer

The items are specially shaped and fitted carrying cases designed to provide storage, protection, organization and portability for the personal effects contained within. Each item is said to be manufactured with an exterior surface of a textile material consisting of 80% polyester and 20% cotton. The exterior is in chief weight of the polyester man-made textile material. The interior of each bag is specially designed with various size open/zippered compartments/pockets designed to contain craft accessories. The bags range in size from approximately 5” x 6.4” x 2.6” to 22.5 x 12.6” in their unfolded condition. Your samples are being returned as requested.

The applicable subheading for the carrying cases will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTS), which provides in part, for other bags and containers, with outer surface of textile materials, other, other, of man-made fibers. The duty rate will be 17.6 percent ad valorem.

HTS 4202.92.9026 falls within textile category designation 670. Based upon international textile trade agreements products of China are not currently subject to quota and the requirement of a visa.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
