RE: The tariff classification of two geotextile fabrics from China.

Dear Ms. Perez:

In your letter dated May 10, 2004, on behalf of your client BMT Commodity Corporation, you requested a tariff classification ruling.

Two samples of fabric accompanied your request for a ruling. The first, designated as style Geotex 311, is a dyed needleloom felt material composed of 100% polypropylene staple man-made fibers. Weighing approximately 92 g/m2, it will be imported in 150 or 180 inch widths. This product will be used for soil stabilization.

The applicable subheading for the needleloom felt fabric designated as style “Geotex” 311 will be 5602.10.9090, Harmonized Tariff Schedule of the United States (HTS), which provides for felt, whether or not impregnated, coated, covered or laminated, needleloom felt and stitch-bonded fiber fabrics, other, other. The duty rate will be 10.6 percent ad valorem.

Goods classifiable in subheading 5602.10.9090, HTS, which are products of China are not subject to either quota restraints or visa requirements.

Your inquiry does not provide enough information for us to give a classification ruling on the woven geotextile designated as “Propex Silt Stop”. Your request for a classification ruling should include the relative weights of the polypropylene strip and the polypropylene yarns. In addition, please provide the width of the strips. Please indicate how the black polypropylene yarns are manufactured including specifying if made from filament yarns and if they are air entangled. When this information is available, you may wish to consider resubmission of your request. We are returning any related samples, exhibits, etc. If you decide to resubmit your request, please include all of the material that we have returned to you.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
