RE: The tariff classification of artificial flower pins from China.

Dear Mr. Ellefson:

In your letter dated May 14, 2004, you requested a classification ruling.

You have submitted two samples. The first sample is identified as style number 1123. The artificial flower is made of 90 percent cotton and 10 percent polyester woven fabric. A metal hair clip is glued to the back of the flower for the purpose of attaching the flower to clothing or to place it in the hair. The artificial flower is attached to a display card.

The second sample is identified as style number 1124. The artificial flower is composed of leather and plastic. It is attached to a metal hair clip and a metal pin allowing the wearer to use the flower pin as a clothing accessory as well as a hair ornament. The artificial flower is attached to a display card. Both samples are marketed as hair accessories.

The samples are returned as you requested.

The applicable subheading for the artificial flowers with pins attached will be 6702.90.6500, Harmonized Tariff Schedule of the United States (HTS), which provides for articles of artificial flowers, foliage and fruit and parts thereof; articles made of artificial flowers, foliage or fruit: Of other materials: Other: Other. The rate of duty will be 17 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
