RE: The tariff classification of artificial foliage from China.

Dear Mr. Belleville:

In your letter received in this office on May 3, 2004, you requested a classification ruling.

You have submitted three samples of artificial wreaths that are composed of plastic strips that have been wrapped around wire stems to appear as branches. The wreaths are fashioned on a wire back with decorations.

The first sample identified as item number VW/WAL04M/21CF is a wreath composed of plastic strips that have been wrapped around wire stems. The artificial wreath is decorated with natural pine cones and fashioned on a wire back. The natural pine cones and tips of some of the artificial branches are flocked with artificial snow.

The second sample is identified as item number 0.B41V-VW040A. The branches of the wreath are composed of plastic strips that have been wrapped around wire stems. It is decorated with green/blue plastic berries, natural pine cones and natural twigs. The wreath is fashioned with a wire back.

The third sample is identified as item number 0.B41W-VW040A. This wreath is composed of plastic strips that have been wrapped around wire stems. It is decorated with plastic red berries made of styrofoam and natural pine cones. This wreath is made onto a wire back. The essential character of all of the above mentioned wreaths is imparted by the artificial foliage.

The applicable subheading for all three decorated wreaths will be 6702.10.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for artificial flowers, foliage and fruit and parts thereof; articles made of artificial flowers, foliage or fruit: Of plastics: Assembled by binding with flexible materials such as wire, paper, textile materials, or foil, or by gluing or by similar methods. The rate of duty will be 8.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
