RE: The tariff classification of a glass beaded article, a metal wall bracket, a metal coat/hat rack, a brass door knob and a glass door knob from India

Dear Mr. Dougherty:

In your letter dated April 26, 2004, on behalf of your client, Urban Outfitters Inc., you requested a tariff classification ruling. Two representative samples and photographs from catalogue pages depicting the items you wish to import were submitted with your ruling request. The two samples will be returned to you as requested.

The first item, which you describe as “Lobster Hook” - style #03106115105, is a decorative glass beaded article in the form of a lobster with two hooks. The article is composed of a metal frame that is completely covered in multi-colored glass beads. It is designed to hang on a wall. The measurements are approximately 14 inches in length and 12 inches at its widest point (lobster claws).

The applicable subheading for the decorative glass beaded article will be 7018.90.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for glass beadsand articles thereofother: other. The rate of duty will be 6.6 percent ad valorem.

The second item, sku #8399057, is described as an iron wall bracket designed to support a shelf.

The third item, which is described as “Metro Mirror” - item #87109, is a wall-mount metal coat/hat rack with a mirror. The article consists of a large metal top shelf, four metal coat hooks and an oval-shaped mirror.

The applicable subheading for sku #8399057 and item #87109 will be 8302.50.0000, HTS, which provides for hat-racks, hat pegs, brackets and similar fixtures, and parts thereof, of base metal. The rate of duty will be free.

The fourth item, style #47006, is a clear-colored, glass door knob with metal hardware. The last item, sku #9087776, is described as a brass door knob with a flower design.

Your letter asked whether the proper classification is determined by the material that makes up the knob portion. For each item, the knob portion imparts the essential character.

The applicable subheading for the glass door knob will be 7020.00.6000, HTS, which provides for other articles of glass: other. The rate of duty will be 5 percent ad valorem.

The applicable subheading for the brass door knob will be 8302.41.9045, HTS, which provides for base metal mountings, fittings and similar articles suitable for furniture, doorssuitable for buildings, other, other, suitable for interior and exterior doors, other. The rate of duty will be 3.5 percent ad valorem.

Articles classifiable under subheading 7018.90.5000, 7020.00.6000, and 8302.41.9045, HTS, which are products of India, are currently entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP, however, is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. To obtain current information on GSP, check our Web site at www.cbp.gov and search for the term "GSP".

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
