RE: The tariff classification of a glove from Indonesia.

Dear Ms. Thomas:

In your letter dated April 23, 2004, you requested a tariff classification ruling. The provided sample will be returned as per your request.

Style 03013 is a golf glove constructed of a polyurethane coated knitted fabric with a palmside leather thumb and backside knitted fabric inserts across the knuckle area and at the middle section of three fingers. The glove features a backside tab closure wrist tightener which is secured by hook and loop fasteners, perforations on the backside fingers, a leather overlay at the lower outer palm area, an elasticized wrist, and knitted fabric fourchettes.

Coated knitted fabric sports gloves are provided for under HTS, 6116.10.0800. Therefore, your suggestion for classification in Chapter 39, HTS, is not applicable.

The applicable subheading for Style 03013 will be 6116.10.0800, Harmonized Tariff Schedule of the United States (HTS), which provides for Gloves, mittens and mitts, knitted or crocheted: impregnated, coated or covered with plastics or rubber: other gloves, mittens and mitts, all the foregoing specially designed for use in sports, including ski and snowmobile gloves, mittens and mitts. The rate of duty will be 2.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
