RE: The tariff classification of a tote bag from China.

Dear Ms. Kwok:

In your letter dated April 21, 2004, you requested a tariff classification ruling for a tote bag.

The sample submitted is identified as item 90144D. The item is a double handle tote bag designed to contain personal effects and accessories on a daily basis. It is manufactured with an exterior surface of polyvinyl chloride (PVC) plastic sheeting. The interior consists of a single, textile lined compartment with no additional features. It measures approximately 13 ½”(H) x 12”(W) x 5”(D). There is an additional full width/length pocket with flap closure on the front exterior of the bag. The top of the bag is secured by means of a metal snap fastener.

The applicable subheading for item 90144D will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of sheeting of plastic, other. The rate of duty will be 20 percent ad valorem.

You have asked whether this product is subject to antidumping duties or countervailing duties.
