RE: The tariff classification of brass wire from Singapore.

Dear Mr. Teo:

In your letter dated April 19, 2004, on behalf of Graphel Corp., Westchester, OH, you requested a tariff classification ruling.

You have described your product as Inmac EDM brass cut-wire. The wire, which is spooled, will have a diameter range of between 0.15 mm and 0.3 mm. The chemical composition of the product is 65% copper and 35% zinc or 60% copper and 40% zinc (brass). The purpose of the item is for it to be used with electrical discharge machines for wire cutting.

The applicable subheading for the brass wire will be 7408.21.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for copper wire: of copper alloys: of copper-zinc base alloys (brass). The general rate of duty will be 3% ad valorem. Products of Singapore classifiable under subheading 7408.21.0000, HTS, may be entitled to duty free treatment under the United States-Singapore Free Trade Agreement upon compliance with all applicable regulations. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
