RE: The tariff classification of a collapsible carrying bag from China.

Dear Mr. Egan:

In your letter dated April 22, 2004, on behalf of Bay Travelgear, you requested a classification ruling for a collapsible carrying bag.

The sample submitted is identified as item #1 “Collapsible Storage Bag”. The item is a collapsible bag designed to provide storage, protection, organization and portability for such articles as Christmas decorations, etc. It is manufactured with an exterior surface of nylon man-made fiber textile material. The bag’s approximate dimensions are 9 inches high by 11 inches in diameter. The top of the bag is secured by means of a zippered closure around the entire circumference of the bag. It is carried by means of a top-carrying handle. Your sample is being returned as requested.

The applicable subheading for the collapsible bag will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTS), which provides in part, for other bags and containers, with outer surface of textile materials, other, other, of man-fibers. The duty rate will be 17.6 percent ad valorem.

HTS 4202.92.9026 falls within textile category designation 670. Based upon international textile trade agreements products of China are not currently subject to quota and the requirement of a visa.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
