RE: The tariff classification of spunbonded nonwoven fabric, for use in the floral industry, from China.

Dear Mr. Bumgarner:

In your letter which was received April 26, 2004, you requested a tariff classification ruling.

The instant sample, consists of a spunbonded nonwoven fabric which is composed of polyester man-made fibers. You state in your letter that this material has application in the floral industry for such uses as wrapping fresh flowers and plants, etc. We presume that this material will be imported as piece goods, that is, in rolls or in the form of squares or rectangles, as depicted by the instant sample. The submitted sample was informally weighed and was found to weigh approximately 22 grams per square meter.

You further indicate that while this material will be produced in China, it may be shipped to the United States from either China or Hong Kong.

The applicable subheading for the material will be 5603.11.0090, Harmonized Tariff Schedule of the United States (HTS), which provides for nonwovens, whether or not impregnated, coated, covered or laminated, of man-made filaments, weighing not more than 25g/m². The duty rate will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
