RE: The tariff classification of a cosmetic purse from China.

Dear Mr. Liu:

In your letter dated April 8, 2004, on behalf of Best Team International Corp., you requested a classification ruling for a cosmetic purse.

The sample submitted is not identified by style number. The item is a cosmetic purse with a permanently attached mirror designed to contain cosmetics on a daily basis. It is manufactured with an exterior surface of man-made fiber textile material with vinyl trim. The top of the bag is secured by means of a textile zipper closure. It measures approximately 7”(W) x 5”(H) x 2”(D). Your sample is being returned as requested.

The applicable subheading for the cosmetic purse will be 4202.12.8070, Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcases, vanity cases and similar containers, with outer surface of textile materials, other, other, of man-made fibers. The duty rate will be 17.6 percent ad Valorem.

HTS 4202.12.8070 falls within textile category designation 670. Based upon international textile trade agreements products of China are not currently subject to quota and the requirement of a visa.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
