RE: The tariff classification of gun cases from China

Dear Mr. McCoy:

In your letter dated April 12,2004 you requested a tariff classification ruling.

You have submitted samples of two items identified as styles SP 00101 and SP 00104. Each item is a gun case designed to provide storage, protection, organization and portability for a gun.

Style SP 00101 is designed to contain a rifle or shotgun. It is manufactured of aluminum . The case has a single carrying handle of molded plastic. It has a set of combination locks and a dual latches with key locks. The interior is fitted with “egg crate” foam which secures the gun when the case is closed and locked.

Style SP 00104 is designed to contain a pistol. It is manufactured of an aluminum shell that is wholly covered on the exterior with a camouflage textile material. The fabric appears to be of man-made fibers. The gun case is designed similar to a military cartridge case that has a single latch with key lock on one end and a single hinge on the opposite. The interior has a removable top tray of plastics.

The applicable subheading for style SP 00101, gun case of aluminum , will be 4202.99.9000, Harmonized Tariff Schedule of the United States (HTS), which provides for other containers or cases, other, other, other. The rate of duty will be 20 percent ad valorem.

The applicable subheading for style SP 001041, gun case of aluminum with outer surface of textile materials, of man-made fibers , will be 4202.92.9026 Harmonized Tariff Schedule of the United States (HTS), which provides for other containers or cases, other, other, with outer surface of textile materials, other, of man-made fibers. The rate of duty will be 17.6 percent ad valorem.

Articles classified with tariff number 4202.92.9026, HTSUSA, fall within textile category designation 670. Based upon international textile trade agreements products of china are not currently subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
