RE: The tariff classification of a personal air cooler of unspecified origin

Dear Mr. Courson:

In your letter dated March 30, 2004 you requested a tariff classification ruling. A sample was submitted.

The article in question is described as a Misty Mate “Artic Blast” personal air cooler. Examination of the submitted sample reveals that the personal cooler is comprised of a plastic bottle incorporating a hand operated air pump, a plastic hose with a valve and brass spray nozzle, and a fitted carry bag of a textile material. The air pump allows water placed in the bottle to be pressurized and sprayed in a fine mist from the nozzle. The air cooler provides the effect of evaporative cooling in hot, dry weather by allowing a user to spray the mist of water on their person.

The applicable subheading for the “Artic Blast” personal air cooler will be 8424.89.7090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other mechanical appliances for projecting, dispersing or spraying liquids or powders. The rate of duty will be 1.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
