RE: The tariff classification of a wooden jewelry organizer from China.

Dear Ms. Cumins:

In your letter dated March 29, 2004, on behalf of East West Basics, you requested a tariff classification ruling.

The jewelry organizers, models WW1048D and WW10481, are made of solid wood and fiber board. They measure 18½” x 13” x 42½”, contain 8 pull out drawers and are designed to stand on the floor. The top of each piece has a flip up to reveal a mirror with a ring and jewelry tray. There are two breakaway side doors to hang necklaces tangle free.

The applicable subheading for the wooden jewelry organizer will be 9403.50.9080, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other furniture and parts thereof: Wooden furniture of a kind used in the bedroom: Other: Other, Other.” The rate of duty will be free.

Regarding the possibility of antidumping duties being assessed on bedroom furniture from China, we suggest you write to Catherine Bertrand, U.S. Department of Commerce, International Trade Administration, Office of Antidumping Compliance, 14th Street & Constitution Avenue, N.W., R 7866, Washington, DC 20230. Written decisions regarding the scope of AD/CVD orders are issued by the Import Administration in the Department of Commerce.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
