RE: The tariff classification of a turban from China.

Dear Ms. Richings
In your letter dated March 9, 2004 you requested a classification ruling.

The submitted sample is turban towel. You have also submitted swatches of terry cloth fabric that the turban will be made of. Swatch A – woven 100% cotton; Swatch B – woven 95% cotton, 5% polyester; Swatch C woven 80% polyester, 20% polyamide. The terry cloth turban is placed on the head when the hair is wet, twisted and closed with a button to form a turban.

The applicable subheading for the "Turban Towel" Swatch A and B will be 6505.90.2060, Harmonized Tariff Schedule of the United States (HTS), which provides for "Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric, in the piece (but not in strips), whether or not lined or trimmed; hair-nets of any material, whether or not lined or trimmed: Other: Of cotton, flax or both: Not knitted: Certified hand-loomed and folklore products; and head-wear of cotton... Other." The general rate of duty will be 7.5% ad valorem. The textile category designation is 359.

The applicable subheading for the “Turban Towel” Swatch C will be 6505.90.8090, Harmonized Tariff Schedule of the United States (HTS), which provides for "Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric, in the piece (but not in strips), whether or not lined or trimmed; hair-nets of any material, whether or not lined or trimmed: Other: Of man-made fibers: Other: Not in part of braid...Other: Other: Other." The duty rate will be 18.7 cents per kilogram plus 6.8% ad valorem. The textile category designation is 659.

Based upon international textile trade agreements products of China are subject to textile category 659 (Swatch C) is subject to quota and the requirement of a visa. Swatch A and B are not subject to quota and the requirement of visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
