RE: The tariff classification of gloves from China and Pakistan.

Dear Mr. Zelman:

In your letter dated March 2, 2004, you requested a tariff classification ruling on behalf of Magla Worldwide, Ltd.

Style 5626 is an unlined gunn cut work glove constructed of deerskin leather. The glove features a partially elasticized wrist and an open vented cuff with a hemmed bottom. The retail display label attached to the glove sample indicates that the glove is a size medium. The glove is made in China.

Style 6428 is an unlined gunn cut work glove constructed of pigskin leather. The glove features a partially elasticized wrist and an open cuff with a woven fabric trimmed bottom. The retail display label attached to the glove sample indicates that the glove is a size large. The glove is made in China.

Style 5437 is an unlined gunn cut work glove constructed of goatskin leather. The glove features a leather overlay at the base of the palmside fingers, a partially elasticized wrist, and an open cuff with a hemmed bottom. The retail display label attached to the glove sample indicates that the glove is a size medium. The glove is made in Pakistan.

In your letter you state the gloves are unisex and should therefore not be considered men’s for classification purposes. However, we find the submitted samples to be generously sized medium (Styles 5626 and 5437) and large (Style 6428) men’s gloves. Men’s unlined deerskin, goatskin, and pigskin leather gloves are provided for under 4203.29.3010, HTS.

The applicable subheading for all styles will be 4203.29.3010, Harmonized Tariff Schedule of the United States (HTS), which provides for Articles of apparel and clothing accessories, of leather or of composition leather: gloves, mittens and mitts: other: other: other: men’s . . . not lined. The duty rate will be 14 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
