RE: The tariff classification of a colander and a strainer from China

Dear Mr. Mineo:

In your letter dated February 12, 2004, you requested a tariff classification ruling.

The samples you submitted are a colander (item number 70950002805) and a strainer (item number 70950309713). The colander is made of stainless steel mesh and has 2 handles. It measures approximately 8 inches in diameter and 4.5 inches in height. The strainer is made of aluminum mesh and it has a plastic handle. The mesh body has a flat bottom, and measures approximately 3 inches in diameter and 1.5 inches deep.

The applicable subheading for the stainless steel colander will be 7323.93.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for table, kitchen or other household articles and parts thereof, of stainless steel, kitchen ware. The general rate of duty will be 2 percent ad valorem.

The applicable subheading for the aluminum strainer will be 7615.19.7060, Harmonized Tariff Schedule of the United States (HTS), which provides for table, kitchen or other household articles and parts thereof, of aluminum, other, not enameled or glazed and not containing nonstick interior finishes, other, other. The general rate of duty will be 3.1 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
