RE: The tariff classification of ponytail holders and a watch from China.

Dear Ms. Ritchings:

In your letter dated February 5, 2004 you requested a tariff classification ruling.

The submitted sample, Model 58322 consists of 12 ponytail holders and a sports watch that are packaged on a card. The ponytail holders are made of knit man-made fiber fabric.

The applicable subheading for Model 58322, ponytail holders will be 6117.80.8500, HTS, which provides for "Other made up clothing accessories, knitted or crochetedOther Accessories: Other: Headbands, ponytail holders and similar articles." The duty rate will be 14.6% ad valorem.

Your inquiry does not provide enough information for us to give a classification ruling on the sports watch. Your request for a classification ruling should include how the sports watch is worn. Is the item intended to be worn in the hair, or on the wrist? Please also provide advertising materials, pictures, etc. showing how it is worn. When this information is available, you may wish to consider resubmission of your request. We are returning any related samples, exhibits, etc. If you decide to resubmit your request, please include all of the material that we have returned to you.
