RE: The tariff classification of two bonded fabrics and a polyester satin woven fabric from China and Taiwan.

Dear Mr. Manio:

In your letter dated January 26, 2004 you requested a classification ruling.

Three samples of fabric accompanied your request for a ruling. The first, designated as style “Sheepskin”, is a bonded fabric consisting of a weft knit “face” fabric laminated to a weft knit “back” fabric of cut pile construction. The plastic adhesive that bonds these fabrics together is not visible in cross section. The face fabric is a dyed 100% polyester weft knit fabric of interlock construction that weighs 169.5 g/m2. It has been brushed on the outer surface creating a dense fibrous surface simulating the look and feel of suede. The back fabric is a weft knit fabric of cut pile construction constructed with pile yarns composed of a polyester and acrylic blend. The yarns that form the base fabric of this cut pile fabric are composed of 100% polyester. The pile yarns have been textured to simulate the look of sheep’s wool. This back fabric weighs 383.7 g/m2. The bonded fabric weighs 553.2 g/m2 and will be imported in 152 centimeter widths.

Style “Lambskin”, is a bonded fabric consisting of a weft knit “face” fabric of cut pile construction laminated to a greige plain woven “back” fabric. The plastic adhesive that bonds these fabrics together is not visible in cross section. The face fabric is a weft knit fabric of cut pile construction manufactured with pile yarns composed of a blend of polyester and acrylic. The yarns that form the base fabric of this cut pile fabric are composed of 100% polyester. The pile yarns have been textured to simulate the look of lamb’s wool. This face fabric weighs 366.6 g/m2. The back fabric is a greige 100% cotton plain woven fabric that weighs 88.1 g/m2. It functions as a support and reinforcing element in the bonded fabric. The bonded fabric weighs 454.7 g/m2 and will be imported in 150 centimeter widths.

Style “Truesuede-2” is a 4 X 1 satin woven fabric composed of 56.5% staple polyester and 43.5% filament polyester. It is constructed of yarns of different shades of the same color and is characterized by a dense fibrous surface created by brushing or sanding. Although woven with filament yarns, the sanding operation has broken the fiber in a portion of the yarns creating yarns made from staple fiber. Weighing 267.5 g/m2, this product will be imported in 152 centimeter widths.

The applicable subheading for the two bonded fabrics designated as styles “Sheepskin” and “Lambskin” will be 6001.92.0020, Harmonized Tariff Schedule of the United States (HTS), which provides for pile fabrics, including “long pile” fabrics and terry fabrics, knitted or crocheted, other, of man-made fibers, over 271 grams per square meter, other. The duty rate will be 17.2 percent ad valorem.

The applicable subheading for the satin woven fabric designated as style “Truesuede-2” will be 5515.12.0040, Harmonized Tariff Schedule of the United States (HTS), which provides for other woven fabrics of synthetic staple fibers, of polyester staple fibers, mixed mainly or solely with man-made filaments, satin weave or twill weave. The duty rate will be 12 percent ad valorem.

The fabric designated as style “Sheepskin” falls within textile category designation 224. Based upon international textile trade agreements products of Taiwan are subject to quota and the requirement of a visa.

The fabric designated as style “Lambskin” falls within textile category designation 224. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The fabric designated as style “Truesuede-2” falls within textile category designation 628. Based upon international textile trade agreements products of Taiwan are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
