RE: The tariff classification of shopper type tote bag from China.

Dear Mr. Lee:

In your letter dated January 26, 2004, on behalf of Glimpso LLC, you requested a classification ruling for a shopper type tote bag.

The sample submitted is identified as style 4631-1 “Cargo Mesh Tote”. The item consists of a double handle, open top shopper type tote bag measuring approximately 13 ½”(H) x 19”(W) with an 8” base and a matching toiletry bag measuring approximately 8 ½”(W) x 6”(H). The toiletry bag is attached to the tote bag by means of a textile strap with a metal dog leash-type fastener. Both bags are wholly made up of woven polyethylene yarns. Your sample is being returned as requested.

The applicable subheading for style 4631-1 will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of textile materials, other, of man-made fibers, other. The duty rate will be 17.6 percent ad valorem.

HTS 4202.92.3031 falls within textile category designation 670. Based upon international textile trade agreements products of China are not currently subject to quota and the requirement of a visa.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
