RE: The tariff classification of a “Deluxe Rock Tumbler” from China.

Dear Mr. Maher:

In your letter dated January 30, 2004, on behalf of RoseArt Industries, you requested a tariff classification ruling.

You submitted a sample of a “Deluxe Rock Tumbler” identified as item number 4649, which is a set consisting of a rock tumbler machine, stones, packs of grit, jewelry settings, glue and instructions. The rock tumbler machine is an electrically operated device for polishing rocks, stones and minerals. It is entirely made of plastic with the exception of a 10-watt motor, and has an on/off button. The longer the machine operates, the more polished the stones will become. For polishing stones, in addition to the rock tumbler machine, the set contains 7 ounces of gemstone rocks, one bag of “step 1” coarse abrasive powder, one bag of “step 2” medium abrasive powder, and one bag of “step 3” fine polishing powder. For making jewelry, the set contains 1 necklace, 1 key chain, 1 key ring, 1 pair of wire earrings, 6 jump ring connectors, 1 tie pin, 1 ring, 6 setting holders, and 2 pin backings. The instructions explain how to operate the rock tumbler machine for polishing stones, and making jewelry. The item is a toy set designed for a child 10 years of age and older who will derive amusement from manipulating the various rocks and making jewelry that they will wear.

The applicable subheading for the “Deluxe Rock Tumbler” identified as item number 4649 will be 9503.70.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other toys, put up in sets or outfits, and parts and accessories thereof.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
