RE: The tariff classification of My Pet Kitty/Puppy from China

Dear Mr. Gabriel:

In your letter dated December 31, 2003, you requested a tariff classification ruling.

You are requesting the tariff classification on an item that is described as My Pet Kitty/Puppy, reference # PP 275584. The article will comprise 2 separate styles: a kitty and a puppy. Each style will be sold on its own, accompanied by a pet carrier. The toy contains an IC chip and motor. The chip produces the pet sounds while the motor makes the toy move. The pets are touch-sensitive so that they move and make pet sounds when petted. The correct classification will be in Chapter 95 of the HTS as other toys representing animals, and their accessories. The sample will be returned, as requested.

The applicable subheading for My Pet Kitty/Puppy toy, reference # PP 275584, will be 9503.49.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for toys representing animals or non-human creatures...and parts and accessories thereof: other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
