RE: The tariff classification of gloves from Pakistan or China.

Dear Ms. Keller:

In your letter dated December 8, 2003, you requested a classification ruling on behalf of West Chester Holdings, Inc. The provided samples will be returned as per your request.

Three samples were submitted for review. Style 87000 is a work glove with a complete palmside from fingertips to wrist, vented fourchettes, and backside overlays at the five fingertips, thumb crotch, and base of the thumb constructed of a synthetic leather. The glove backside and complete cuff are made of a three-layer material consisting of foam sandwiched between two knitted fabrics. The palmside features a padded palm patch at the lower portion, two rubberized strips at the upper palm, and PVC lines across the fingers. Additional features include a molded PVC knuckle protector, rubberized strips down the four backside fingers, and an elasticized wrist.

Style 69850 is a horseback riding glove with a complete palmside and fourchettes constructed of a PVC mini-dot coated knitted cotton fabric . The backside of the glove is made of a knitted cotton fabric. Coated fabric overlays are found at the thumb/forefinger crotch extending up the outer forefinger, and also at the pinky/ring finger crotch. Additional features include an elasticized fabric wristband which is secured by hook and loop fasteners.

Style 89850 is a horseback riding glove with a palmside and backside constructed of goat leather. The fourchettes and sidewalls are made of a finely knitted man-made fabric. Leather overlays are found at the thumb/forefinger crotch extending up the outer forefinger, and also at the pinky/ring finger crotch. Additional features include a partially elasticized wrist with a tightener which is secured by hook and loop fasteners and perforations on three of the backside fingers.

The applicable subheading for style 87000 will be 6216.00.5820, Harmonized Tariff Schedule of the United States (HTS), which provides for Gloves, mittens and mitts: other: of man-made fibers: other: with fourchettes . . . other. The rate of duty will be 20.8 cents per kilogram plus 10.5 percent ad valorem. In 2004, the rate of duty will be 20.7 cents per kilogram plus 10.4 percent ad valorem.

The applicable subheading for style 69850 will be 6116.10.0800, HTS, which provides for Gloves, mittens and mitts, knitted or crocheted: impregnated, coated or covered with plastics or rubber: other gloves, mittens and mitts, all the foregoing specially designed for use in sports, including ski and snowmobile gloves, mittens and mitts. The rate of duty will be 3.1 percent ad valorem. In 2004, the rate of duty will be 2.8 percent ad valorem.

The applicable subheading for style 89850 will be 4203.21.8060, HTS, which provides for Articles of apparel and clothing accessories, of leather or of composition leather: Gloves, mittens and mitts: Specially designed for use in sports: Other . . . Other. The rate of duty will be 4.9 percent ad valorem. In 2004, the rate of duty will remain the same.

Style 87000 falls within textile category designation 631. Based upon international textile trade agreements products of Pakistan and China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
