RE: The tariff classification of map cases from China.

Dear Mr. Toben:

In your undated letter, received in this office December 15, 2003, on behalf of MadMaps, you requested a classification ruling for map cases.

You have submitted six samples with your request identified as 4-fold and 2-fold “Map Folders”. No style numbers were submitted. The items are specially shaped and fitted cases designed to protect, store and organize maps and documents in an automobile. The cases are manufactured with an exterior surface of 100% polyester and/or 100%cotton textile materials. They measure approximately 11”(L) x 6”(W) in their folded position. Each case is secured by means of metal snap fasteners.

The applicable subheading for the map cases of 100% polyester will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTS), which provides in part, for other bags and containers, with outer surface of textile materials, other, other, of man-made fibers. The duty rate will be 17.8 percent ad valorem. The duty rate for 2004 will be 17.6 percent ad valorem.

The applicable subheading for the map cases of 100% cotton will be 4202.92.6091, HTS, which provides in part, for other bags and containers, with outer surface of textile materials, other, other, of cotton. The duty rate will be 6.4 percent ad valorem. The duty rate for 2004 will be 6.3 percent ad valorem.

HTS 4202.92.9026 falls within textile category designation 670. HTS 4202.92.6091 falls within textile category designation 369. Based upon international textile trade agreements products of China are not currently subject to quota and the requirement of a visa.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
