RE: The tariff classification of two glass kitchen storage articles and one decorative glass article from China

Dear Ms. Tuchel:

In your letter dated January 8, 2004, you requested a tariff classification ruling. Three representative samples were submitted with your ruling request.

The first item consists of two glass salt and pepper shakers in a removable woven grass holder. Each shaker has a removable perforated twist-off metal lid and measures approximately four inches in height. You indicated in your letter that the unit value of each glass shaker is not over $3.00.

The second item consists of two glass oil and vinegar bottles in a removable woven grass holder. Each bottle has a removable perforated twist-off metal lid and measures approximately six inches in height. You indicated in your letter that the unit value of each glass bottle is not over $3.00.

The applicable subheading for the two glass storage articles - salt and pepper shakers and oil and vinegar bottles will be 7013.39.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for glassware of a kind used for table (other than drinking glasses) or kitchen purposes other than that of glass-ceramicsotherothervalued not over $3 each. The rate of duty will be 22.5 percent ad valorem.

The third item is an oval-shaped glass canister with a removable metal lid. The exterior surface of the glass is covered in woven grass. The article measures approximately six inches in height and five inches in diameter. You indicated in your letter that the canister could be used to hold a variety of items. You stated in your letter that the unit value of the glass canister is over $0.30 but not over $3.00.

The applicable subheading for the glass canister will be 7013.99.5000, HTS, which provides for glassware of the kind used for table, kitchen, toilet, office, indoor decoration or similar purposes... other glassware: other: other: other: valued over thirty cents but not over three dollars each. The rate of duty will be 30 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
