RE: The tariff classification of packaging ribbon from China

Dear Mr. O’Neill:

In your letter dated December 3,2003, on behalf of American Greetings, you requested a tariff classification ruling.

There were three samples submitted with your letter.

Item SKU 003626TAE is described as a blue iridescent garland of braided string attached with light blue plastic tinsel, used as packaging ribbon, and composed of 95% PVC tinsel/5% nylon thread.

Item SKU 003623TAE is described as a red iridescent garland of braided string attached with red plastic tinsel, used as packaging ribbon, and composed of 95% PVC tinsel/5% nylon thread.

Item SKU 003617TAE is described as a silver iridescent garland of braided string attached with silver foil tinsel, used as packaging ribbon, and composed of 95% PVC tinsel/5% nylon thread.

The applicable subheading for the SKU 003626TAE, SKU 003623TAE, and SKU 003617TAE will be 5808.90.0090, Harmonized Tariff Schedule of the United States (HTS), which provides for braids in the piece; ornamental trimmings in the piece, without embroidery, other than knitted or crocheted; tassels, pompons and similar articles: other other. The rate of duty for 2003 will be 4.3 percent ad valorem. The rate of duty for 2004 will be 3.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
