RE: The classification of two DVD players with monitors and cases from China.

Dear Mr. Sunakoda;

In your letter dated October 2 4, 2003, on behalf of your client Nissho Iwai American Corporation, you requested a tariff classification ruling.

The samples you have submitted, 2 DVD players with TFT LCD Displays and Carrying Cases (Models TDB568 and TDB25668), are exactly what their product title says. Each model has a DVD player, which can play DVDs, VCD, CD, CD-R, CD-RW and MP3 formatted discs. The items do not have TV tuners or any recording capabilities. Both models have TFT LCD display color monitors with a 5.6 inch diagonal display. Model TDB2568 has 2 TFT LCD display monitors. These items are designed for use in motor vehicles and have anti-shock and anti-vibration features. The items also come with custom bags, which are specially fitted, to function with these particular DVD/monitor systems.

Based upon HQ Ruling 964149 this office considers the carrying case, when imported with the DVD player with monitor, to be a GRI 5(a) container.

The applicable subheading for both of the DVD players with color monitors (Models TDB568 and TDB25668) will be 8528.21.5501, Harmonized Tariff Schedule of the United States (HTS), which provides for Reception apparatus for television, whether or not incorporating radiobroadcast receivers or sound or video recording or reproducing apparatus; video monitors and video projectors: Video monitors: Color: With a flat panel screen: Incorporating video recording or reproducing apparatus: With a display diagonal not exceeding 34.29cm. The rate of duty will be free.

As requested, both samples are being returned to you

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
