RE: The tariff classification of a barcode scanner from Canada.

Dear Mr. Morgan:

In your letter dated October 23, 2003 on behalf of your client Wired Time Com Inc., you requested a tariff classification ruling.

The merchandise under consideration is the WT100 Barcode Scanner. The WT100 is a small handheld barcode scanning device that connects directly to a number of compatible mobile phones and other Java-Enabled phones designated in the Wired Time literature. Utilizing mobile phone technology for wireless connectivity, this device will allow its user the ability to scan barcodes at remote locations and transmit that data to another location. When combined with a compatible mobile phone, the WT100 will transfer captured barcode information to a server over the Internet. By utilizing the integrated Charge Coupled Device (CCD) scanning engine, it allows for the scanning and decoding of a number of different barcode types (i.e., Code 39, Code 128, EAN 8, UPC-A and UPC-E) in various light conditions. A 3.8v Li-Lon rechargeable battery powers the WT100. Other hardware specifications included RS-232 Interface, Motorola iDen connector, Buzzer for audible alerts and LED user interface.

The WT100 is an optical reader designed for use with a mobile phone. Explanatory Note 84.71(II)(A)(2) indicates that the term optical readers includes bar code readers that are not elsewhere specified or included.

The applicable subheading for the WT100 Barcode Scanner will be 8471.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for “magnetic or optical readers, machines for transcribing data onto data media in coded form and machines for processing such data, not elsewhere specified or included: Other.” The general rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
