RE: The tariff classification of a woman's robe and pouch from China

Dear Ms. DeSilva:

In your letter dated October 30, 2003, you requested a ruling on tariff classification. The sample submitted with your request will be returned to you under separate cover.

Style PP#270225 consists of a woman’s robe and matching pouch constructed from 100 percent polyester satin woven fabric. The kimono-styled robe features ¾ length sleeves, two side seam pockets and a full front opening secured by a self-fabric tie belt. The robe features embroidery on the front panels and upper back panel. The pouch measures 11 inches by 10 inches with a flap secured by a frog-like closure. The back of the pouch has an embroidered design.

The robe and pouch are considered a composite good in accordance with General Rules of Interpretation 3(b). The essential character is provided by the robe, therefore, both the robe and pouch will be classified under the HTS number for the robe. Both the robe and pouch will fall under the same textile category designation.

The applicable subheading for style PP#270225 will be 6208.92.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ singlets and other undershirts, slips, petticoats, briefs, panties, nightdresses, pajamas, negligees, bathrobes, dressing gowns and similar articles: other: of man-made fibers: bathrobes, dressing gowns and similar articles: women’s. The rate of duty will be 16.1 percent ad valorem.

Style PP#270225 falls within textile category designation 650. Based upon international textile trade agreements products of China are not currently subject to quota restraints or the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.).
