RE: The tariff classification of a table topper, tablecloth, table runner, curtain panel, curtain valance, curtain swag and curtain tier from India.

Dear Mr. Scott:

In your letter dated October 9, 2003 you requested a classification ruling.

You submitted a sample of a curtain valance. The valance is made from 100 percent cotton knit fabric. All four edges are hemmed. The top edge features a rod pocket. The valance measures 14 x 68 inches. You will also import a table topper, tablecloth, table runner, curtain panel, curtain swag and curtain tier made from the same fabric as the valance. The items will measure as follows: table topper 36 inches square, tablecloth 52 inches square, table runner 13 x 36 inches, curtain panel 63 x 68 inches, curtain swag 36 x 68 and the curtain tier 24 x 68 inches. Samples of these items were not submitted.

The applicable subheading for the table topper will be 6304.91.0020, Harmonized Tariff Schedule of the United States (HTS), which provides for other furnishing articles, excluding those of heading 9404: other: knitted or crocheted of cotton. The duty rate will be 6.4 percent ad valorem.

The applicable subheading for the tablecloth and table runner will be 6302.40.2010, HTS, which provides for bed linen, table linen, toilet linen and kitchen linen: table linen, knitted or crocheted: other of cotton. The duty rate will be 6.9 percent ad valorem.

The applicable subheading for the curtain panel, swag, valance and tier will be 6303.11.0000, HTS, which provides for curtains (including drapes) and interior blinds: curtain or bed valances: knitted or crocheted: of cotton. The rate of duty will be 10.4 percent ad valorem.

All of the items fall within textile category designation 369. Based upon international textile trade agreements the tablecloth and table runner from India are subject to the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
