RE: The tariff classification of a tool organizer from China.

Dear Mr. Bounds:

In your letter dated September 30, 2003, on behalf of Midwest Quality Glove, Inc., you requested a classification ruling for a tool organizer.

A sample of style TG56 “Bucket Organizer” has been submitted. The item is similar to a tool roll in design. It is manufactured of 100% polyester man-made fiber textile material with PVC backing. The organizer is specially fitted with 14 pockets and elastic loops designed to provide storage, protection and portability for the tools it is designed to contain. It measures approximately 22 ½”(L) x 17”(W) in its unfolded condition. Your sample is being returned as requested.

The applicable subheading for the tool organizer will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTS), which provides in part, for other bags and other containers, with outer surface of textile materials, other, other, of man-made fibers. The duty rate will be 17.8 percent ad valorem.

HTS 4202.92.9026 falls within textile category designation 670. Based upon international textile trade agreements products of China are not currently subject to quota and the requirement of a visa.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
