RE: The tariff classification of Christmas tree ornaments from China.

Dear Ms. Chastain:

In your letter received in this office on September 25, 2003, on behalf of your client Decorator and Craft Corp., you requested a classification ruling.

You have submitted one sample identified as item number 44-3576. It is a red 4.5” bell ornament decorated with cut out stars. You also submitted photographs depicting four additional Christmas tree ornaments with cut out stars. These ornaments are made with a small bell inside. When the Christmas tree branches are moved the sound of sleigh bells ringing is heard. All of the Christmas tree ornaments are designed with a hanger loop on the top so it can easily be hung on a Christmas tree.

Item number 44-3579 is a gold tone 4.5” ornament. Item number 44-3587 is a red cardinal and item number 44-3589 is a chickadee ornament.

Item number 44-3581 is a 4.5” ornament with a coating of clear beads creating a sugar coated appearance. Additional information is required to render classification of this ornament. We need to know what the beads are made of. If they are glass beads, we need a sample and a value breakout.

The sample is returned as you requested.

The applicable subheading for the above mentioned Christmas tree ornaments (excluding item number 44-3581) will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for Festive...articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: Other: Other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
