RE: The tariff classification of a handbag, coin purses, glitter glue, ribbon, key ring, and imitation gemstones from China.

Dear Mr. Maher:

In your letter dated September 4, 2003, on behalf of Roseart Industries, you requested a classification ruling.

The sample submitted is identified as style #5042 “Designer Denim Creations”. The item consists of a child’s shoulder bag, two coin purses, three sticks of glitter glue, plastic imitation gemstones, and a steel wire, split-ring key ring attached to a rectangular piece of denim material. The shoulder bag and coin purses are manufactured of 100 percent cotton denim textile material. The above listed items will be imported packed and sold at retail together as a set. However for classification purposes, taken as a whole, the items are not considered to be a set or an educational toy, nor is the play value greater than the useful functions of the purses. Your sample is being returned as requested.

The applicable subheading for the child’s shoulder bag of cotton denim will be 4202.22.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strap, including those without handle, with outer surface of textile materials, of vegetable fibers and not of pile or tufted construction, of cotton. The duty rate will be 6.4 percent ad valorem.

The applicable subheading for the coin purses of cotton denim will be 4202.32.4000, HTS, which provides for articles of a kind normally carried in the pocket or in the handbag, with outer surface of textile materials, of vegetable fibers and not of pile or tufted construction, of cotton. The duty rate will be 6.4 percent ad valorem.

HTS 4202.22.4500 and 4202.32.4000 falls within textile category designation 369. Based upon international textile trade agreements products of China are not currently subject to quota and the requirement of a visa.

The applicable subheading for the glitter glue will be 3213.90.0000, HTS, which provides for artists’, students’ or signboard painters’ colors, modifying tints, amusement colors and the like, in tablets, tubes, jar bottles, pans or in similar forms or packing: Other. The duty rate will be 3.4 percent ad valorem.

The applicable subheading for the ribbon will be 5806.32.1090, HTS, which provides for narrow woven fabrics, other than goods of heading 5807; other woven fabrics; of man-made fibers; other. The duty rate will be 6.3 percent ad valorem. There are no quota restrictions or visa requirements for merchandise from China classified in this provision.

The applicable subheading for the key ring will be 7326.20.0070, HTS, which provides for articles of iron or steel wire, other. The duty rate will be 3.9 percent ad valorem.

The applicable subheading for the plastic imitation gemstones will be 3926.90.4000, HTS, which provides for other articles of plastics and articles of other materials of headings 3901 to 3914: Imitation gemstones. The rate of duty will be 2.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
