RE: The tariff classification of gloves from Sri Lanka.

Dear Mr. Pender:

In your letter dated September 17, 2003, you requested a tariff classification ruling. We are returning the submitted samples as per your request.

The provided sample, Style VU9151 is a glove constructed of a washable leather covering the palmside thumb and the majority of the palmside which overlaps the backside fingertips. The backside thumb which serves as a nosewipe is made of a synthetic leather material. Padded fabric inserts are found at the middle of three of the backside fingers. The balance of the glove including the lower palmside, backside, sidewalls and fourchettes are made of a three-layer material consisting of polyurethane plastic sandwiched between woven nylon fabric on the outer surface and a knitted pile polyester fabric on the inner surface. Additionally the glove features a fabric cuff with a tab wrist tightener which is secured by hook and loop fasteners. The glove shows design for use in the sport of snowboarding.

You suggested classification under 6116.10.0800, HTS, as a knitted coated fabric glove. However, the inner polyurethane plastic layer serves as an adhesive, not a coating of the two other layers of the fabric. The essential character of the glove is imparted by the outer woven nylon fabric that is classifiable in chapter 62.

The applicable subheading for Style VU9151 will be 6216.00.4600, Harmonized Tariff Schedule of the United States (HTS), which provides for Gloves, mittens and mitts: other: of man-made fibers: other gloves, mittens and mitts, all the foregoing specially designed for use in sports, including ski and snowmobile gloves, mittens and mitts. The rate of duty will be 3.1 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
